Paternity/Parentage in California

A paternity/parentage action aims to form a parental relationship between a father (or other person) and a child. Once paternity is established, the parent and the child have specific rights and responsibilities going forward. 

With limited (but important) exceptions, spouses are conclusively presumed to be the parents of a child born during their marriage. However, there is generally no such conclusive presumption for a child born to an unwed parent.. In those cases, steps may need to be taken to establish a legal parental relationship with the other parent. 

How to Establish Paternity/Parentage 

In California, there are two key ways to establish paternity/parentage:

  1. Voluntary declaration of paternity: This involves both parents voluntarily signing and acknowledging that they are the legal parents of the child.
  1. Judicial action: The mother, a person who claims to be the other parent, a child support agency, a child, and certain others, can ask the court to determine  paternity/parentage.

The court is authorized to order paternity tests to determine the child’s biological father. However, legal parentage need not be awarded to the biological parent in all cases. Depending on the circumstances, parentage can even be granted to a nonbiological parent over the objections of a competing biological parent.
