Community Property vs. Separate Property

California is a community property state, which means that most property acquired during marriage is equally owned by both spouses. This means that when a divorce occurs, the court will divide the community property so that the value of all community property awarded to each party is equal.

Each spouse may also have separate property, which belongs only to that spouse and is not divided in a divorce.  Separate property generally includes:

  • Assets acquired before marriage
  • Assets acquired by gift or inheritance (including during marriage)
  • Assets acquired after separation

Premarital and post-marital agreements can alter spouses’ property rights.
